Comelec 1st division disqualifies Poe from 2016 presidential race

Senator Grace Poe was disqualified by the Comelec 1st Division by a vote of 2 – 1. The next step would be an en banc Comelec vote. Five of the seven commissioners have already voted against her (because she lost 3 – 0 in a related case in the 2nd Division), while one voted in her favor (in this 1st Division vote). Thus, only the vote of the Chair has not been revealed but it can not alter the outcome (unless some of those who previously voted to disqualify change their minds). Then there is the Supreme Court route. The issue of whether her name would be included in the ballot also has to be resolved. If yes, then her name would be attached with an ASTERISK (*) to mean that a protest is still in process. She may win the May 2016 elections and still be DISQUALIFIED by the Supreme Court. Suffice it to say that if her name is not included in the ballot, then she can not be voted upon.

The cloud of UNCERTAINTY will test the drawing power of Grace who topped the 2013 Senatorial race. Her greatest problem is the entry of Davao Mayor Rodrigo Duterte in the Presidential derby. Grace was the survey leader for many months before the on again – off again Davao mayor finally decided to throw his hat in the political ring. The most recent surveys have now put Digong as the survey front-runner. From a nearly constant 15% of the voting population that sided with Duterte during the months when there was no assurance of a Duterte Presdential run,  Digong now has 38% of the votes while Grace lost her high 30s to low 40s in terms of voter preference and is now in the mid 20s range. This can only mean that Duterte got most of his increase in acceptance from the formerly Poe voters. Duterte and Poe are relatively new comers in the national scene while Vice President Binay and former Senator Roxas have been in the limelight for years. Both Binay and Roxas are considered as TRAPOs (or traditional politicians) with the nation showing signs of FRUSTRATION on how things are in the Philippines, which merely means that there is a CLAMOR for CHANGE which both Poe and Duterte represent.

A Comelec en banc loss plus the prospect of a long legal battle in the Supreme Court (which may end AFTER the 2016 elections – after Poe has won or lost) is too heavy a burden to pass on to Poe supporters so only the heavily committed (to her) may stay with her on Election Day while her “soft” supporters may seek other options with Mayor Duterte as the greatest beneficiary of formerly Poe votes. It would be too easy for Duterte campaigners to say that a vote for Poe could be a WASTED vote (assuming she wins the elections BUT is DISQUALIFIED with FINALITY by the Supreme Court)

Comelec 1st division disqualifies Poe from 2016 presidential race

The Commission on Elections (Comelec) first division has disqualified Sen. Grace Poe to join the 2016 presidential elections.

In a 2-1 vote on Friday, Comelec voted to cancel Poe’s certificate of candidacy (COC).

The Comelec ruled in favor of petitions filed by University of the East College of Law Dean Amado Valdez, former Sen Francisco Tatad and De La Salle University Professor Antonio Contreras.

Poe’s legal counsel lawyer George Garcia said the senator has been informed of the decision.

Garcia said they would file a motion for reconsideration on Tuesday or Wednesday next week.

The Comelec second decision has earlier disqualified Poe from running for the highest position in the country in the 2016 elections.

The Comelec first division ruled on the petition filed by lawyer Estrella Elamparo, which seeks to disqualify Poe on the ground that she failed to satisfy the required 10-year residency provided in the Constitution. With reports from the Tina Santos, Philippine Daily Inquirer/RAM

Unang beses pa lang si Digong naguna bagamat hindi naman klaro ang kanyang pagpayag o pagtanggi sa laban para sa kataastaasang posisyon sa Pilipinas. Nilait ng mga kalaban nya sa pulitika ang resulta ng Pulse Asia survey. Bakit daw sa Metro Manila lang ginawa at hindi sa buong Pilipinas?

May ilan pang mga survey na lumabas (mula sa DZRH at sa Social Weather Station) kung saan untiunting lumiliwanag na si Mayor Duterte ang napupusuan ng maraming botanteng Piipino. Maganda kasi at maayos ang pamamalakad sa Davao City (sa kalinisan at kawalan ng krimen) at maraming Pilipino ang umaasa na magagawa lahat ng ito sa buong Pilipinas. Sa isyu nalang ng pambansang katahimikan, bukod tangi na si Duterte lamang ang dinadala ng lahat ng mga nagsasagupaang pwersa sa labanan sa Mindanao (rebeldeng sundalo, NPA, MNLF, MILF, AFP at PNP) sapagkat sa kaibuturan ng kanilang mga puso ayaw naman talaga nila ng digmaan. Si Digong ang nasa kainggitingbiopic dutertegit na posisyon kung saan maari nyang tapusin ang gera sa Mindanao na ilang dekada na ang tinatakbo.

President Aquino admits FACEBOOK FAILURE

Philippine President Benigno Aquino lll lashed out at social media, specifically FACEBOOK in obvious frustration over criticisms received by his Administration. On his sixth year in office and due to step down in June 30, 2016, the second-generation (son of President Cory Aquino) Chief Executive is DESPERATELY campaigning to have his Liberal Party mate former Senator and Department of the Interior and Local Government Secretary Mar Roxas replace him in national elections on May 2016. Mar Roxas, who lost his bid to become Vice President in 2010, is currently running FOURTH in poll surveys. Clean and honest elections in 2016 would almost certainly make Davao Mayor Rodrigo Duterte (who just recently seized the number one slot), Senator Grace Poe (survey front-runner for a few months back) and Vice President Jejomar Binay who had declared his intentions as far back as 2010 (who was survey front-runner for years prior to graft and corruption charges hurled against him).

Senator Grace Poe was DISQUALIFIED by a Comelec division with an appeal for a Comelec en banc decision. Should Senator Poe lose out on this one, she can bring the case up to the Supreme Court. Her case is about her natural-born citizenship status and the mandatory 10 year residency period in the Philippines prior to the May 2016 elections.

While Senator Poe has a Philippine CONSTITUTIONAL problem, Mayor Duterte has an election PROCEDURAL issue considering he did not file his Certificate of Candidacy during the prescribed period so he is now using the SUBSTITUTION CLAUSE to run for President.

Vice President Binay has been hounded by graft and corruption issues for many months now so there is also a chance that the Aquino Administration can get him out as a candidate with the use of the Department of Justice and the Ombudsman.

In other words, President Aquino is banking on Mar Roxas to win on the basis of having NO OPPONENT (unless we count the cancer-stricken Senator Miriam Defensor Santiago as a worthy election adversary).

With so many possibilities of candidates being excluded from the ballot list or candidates having ASTERISKS (*) beside their names to mean an election protest is on-going, P-Noy is hoping, praying and pleading for a Mar Roxas victory no matter how the win comes about. Of course, there is the issue of election cheating using the PCOS (counting machines) but that is another story.

President Aquino bashes Facebook because it is an arena he can not control. Mainstream media (newspapers, radio and television) have paid advertisements to deliver his message of good performance and a call for Mar Roxas to continue his programs. This situation favors the well funded candidates. There are also paid HACKS who dominate opinion columns and news reports. Facebook is relatively new and DIFFICULT to control. As this blog has always stated, FACEBOOK WOULD DECIDE the next Philippine President in 2016.

Facebook SAVED Duterte Campaign

Presidential candidate Davao City Mayor Rodrigo Duterte is STILL in the running for the highest position of the land. Days after an actual or perceived insult on the Prince of the Catholic Church, Pope Francis, Mayor Digong is still swinging, sometimes wildly, and dishing out his usual cuss words. In a predominantly Catholic country, that was just recently visited by the Pope, few candidates can get away with, to put it mildly, IRREVERENT comments without getting the ire of the voting populace. Surprisingly, Mayor Duterte is still most probably leading the poll surveys that would be conducted and/or results released soon. The Davao mayor, for the first time, led in the most recent popularity contest conducted in Metro Manila.

In the heat of the battle going into a Presidential election, a single statement, action/inaction or event can be magnified a thousand times over and the lucky/unlucky candidate can find himself propelled upwards or pushed downwards, sometimes irreversibly. The death of former President Cory Aquino gave her son Noynoy, now called P-Noy, the chance to seize the Presidency (at the expense of Liberal Party mate Mar Roxas who had to slide down and run in a losing effort for the Vice Presidency). Few people would have voted for lackluster Senator Noynoy if Cory had not died at that particular period. This time around, Mayor Duterte courted political disaster by uttering curse words that devout Catholics could not stomach. In past elections, prior to the advent of SOCIAL MEDIA, Duterte would be DEAD MEAT by this time, what with the constant barrage of negative comments and reports coming from mainstream media (newspapers, radio and television).

In the old days, bad publicity could only be countered by the “obligatory” side of the center of controversy to be ventilated. Whole articles can lash out at the “victim” whose only consolation is that a few sentences would be published getting his version of the story. It would be the same for radio and television. Depending on the number of days that the controversial story would run, the perceived erring party would be a virtual punching bag with one and all invited to box and/or kick the usually defenseless erring person. Today, this is exactly what happened to Mayor Duterte, he is placed in an uncomfortable position trying to justify what he did (that he was just FRUSTRATED at the vehicular traffic jam) at the same time that he has to apologize for biopic dutertecursing the Pope (which, he claims, was not his true intention).

If the Philippines is still in the DARK AGES of total information control by mainstream media, Mayor Duterte would be struggling right now from the near-fatal blow that he got for failing to keep his mouth shut. However, in this Internet age, social media has captured the imagination of the Filipino people with Duterte admirers taking to Facebook to minimize losses, bide for time and launch a media counter-offensive all at the same time. While there is still a steady stream of Pope related stories, naturally negative to the Duterte cause, in mainstream media, in CYBERSPACE Duterte is WINNING points due to the sheer number of his sympathizers who say they would rather have a politician who CURSES rather than a public official who STEALS. Others bash the Catholic Church for anointing THIEVES (with pictures of CONVICTED felon Erap, PLUNDER charged Gloria Macapagal Arroyo, Juan Ponce Enrile and Bong Revilla all hearing mass, being anointed or receiving Holy Communion in the company of Catholic bishops). Some pro-Duterte posters compare the mayor to the womanizing hero Jose Rizal and the foul mouthed General Antonio Luna (recently the subject of a blockbuster movie).

Since Facebook is a twenty-four hour activity, Duterte supporters have seized the UNFORTUNATE UTTERANCE and have turn the near-tragedy to a rallying point that would, hopefully, bring in more people who would be spending more time in defending and campaigning for their Presidential candidate. There are still five months till election day in May 2016, this should be enough time to get this INCIDENT out of the way so that the good mayor can again concentrate on more pressing issues like CRIMINALITY, Metro Manila TRAFFIC and NATION BUILDING.

Comelec DISQUALIFIES Poe on citizenship and residency issues

Independent Senatorial candidate Senator Grace Poe was DISQUALIFIED by the Comelec Second Division for failing to hurdle her natural-born citizenship status and her minimum residency of 10 years to run for President.

She has the option to file for an appeal which would be heard by the Comelec en banc. A negative decision for Poe would force her to appeal to the Supreme Court.

The DISQUALIFICATION comes at a bad time after she lost her poll survey lead to Davao Mayor Rodrigo Duterte in a recently concluded study conducted in Metro Manila.

The main effort of Poe would have to be aimed at her name being included in the soon-to-be printed ballots while her appeal is ongoing. There is a provision to put an ASTERISK after her name to mean that a protest is still in process, nevertheless, she can be voted upon BUT still be DISQUALIFIED should the Supreme Court rule against her.

Legal experts believe that on a LEGAL plane Poe does not have a chance to run for President, however, a POLITICAL decision may still come out so the country may have to bear more months of uncertainty. The Supreme Court can DELAY a FINAL DECISION until after the May 2016 elections opting to allow her to win in case she gets the most number of votes under the principle of Vox Populi, Vox Dei (the voice of the people is the voice of God) while they need not make any decision should she lose the elections on the Moot and Academic Principle (meaning there is no point in issuing a decision since she lost anyway).grace no country

President Benigno Aquino lll’s influential (many members of this class enjoy top positions in government as political appointees, they form part of the President’s KKK for “Kapamilya” family members, “Kaklase” classmates and “Kabarilan” shooting buddies) Ateneo de Manila High School batch of 1977 will NOT endorse nor actively campaign for fellow Atenean (ADMHS batch of 1975) Mar Roxas for President in 2016. The batch will, however, go all-out to support the Vice Presidential run of Leni Robredo and the Senate re-election bid of Teofisto “TG” Guingona lll, also a member of ADMHS class of 1977.  The former Senator and DILG Secretary is two years ahead of the batch of President Aquino so many of the 1977 class are familiar with or friends and acquaintances of Mar Roxas since their grade school and high school days. No reason was given for the NON-ENDORSEMENT.

FACEBOOK COULD DECIDE THE NEXT PHILIPPINE PRESIDENT IN 2016

The next factor that determines outcomes in political exercises is the traditional mass media. However, due to the introduction and general acceptance of smartphones, laptops, tablets and other hand-held devices, fewer and fewer Filipinos are buying or reading newspapers thus negating possible advantages for candidates with money to burn. Online news is the default position mainly because it is free. There is little experience, however, on the use of the Internet in the determination of winners in national and local elections.

Now, here comes social media, which is credited for the fall of authoritarian regimes in Tunisia, Libya and Egypt. Facebook and Tweeter were also instrumental in mobilizing hundreds of thousands of protesters for the anti-pork barrel rallies in the Philippines is 2013. In 2014, social media contributed largely to the Occupy Central (Hong Kong) protest movement. In other words, social media, primarily Facebook, now has a successful history of political mobilizations with spectacular results.

The candidates for national office (President, Vice President and Senators) would best be advised to have a sound social media strategy lest they be swept away by the fury unleashed by blogs, twits and Facebook posts.
