PALO, LEYTE, Philippines – Six armed men, said to be part of the private army of Albuera Mayor Rolando Espinosa and his son Kerwin, were killed in a shootout with police in their hometown early yesterday.

Acting police regional director Chief Supt. Elmer Cruz Beltejar said the lawmen returned fire at the armed group in Sitio Tinago, Barangay Benolho where three houses of the Espinosas are located.

Beltejar said the policemen were on routine patrol in the area when the armed group opened fire from one of the houses.

“These members of the Espinosa group were occupying one of the Espinosas’ houses, specifically where the rooster farm is located. They fired first, so our policemen were forced to fire back,” Beltejar said.

Beltejar said the six fatalities have yet to be identified.

Initial reports identified two of the slain suspects as Ricky Gravello of Ormoc City and Teresito Paderangga of Zamboanga City. Three others were only known as “Tatay,” “Edgar” and “Intsik.”

Beltejar said the policemen initially encountered around 12 men armed with automatic weapons.

After the firefight, some of the suspects escaped, leaving behind several high-powered assault rifles, automatic handguns and rifle grenades.

The clash came a day after Mayor Espinosa surrendered to Philippine National Police (PNP) chief Director General Ronald dela Rosa.

Authorities alleged Espinosa has been protecting drug dealers, including his son Kerwin, who has not surrendered.

Espinosa surrendered within the 24-hour deadline given to him by President Duterte to yield or a “shoot-on-sight” order would be issued against him and his son. Dela Rosa has warned the younger Espinosa “will die” if he elects to shoot it out with police.

PNP spokesman Senior Supt. Dionardo Carlos said the armed men are believed to be part of the Espinosa group.

“There was no reason why policemen would open fire (first). The shots came from inside one of the houses, so after the exchange of gunfire the policemen went inside the house after the threat was neutralized. They entered only in the aftermath of the operation,” Carlos said.

Two of the slain suspects were found near the foyer of the mayor’s house, two were shot in the area where fighting cocks are bred and two others lay dead by the gate of Kerwin’s compound.

Carlos clarified the policemen were not on a mission to raid the Espinosa houses but they were on routine patrol when they figured in a firefight with the group.

“It is normal duty to conduct patrol operations in the community. The operation did not specifically target the compound of the mayor. Unfortunately, they were fired upon,” he said.

Carlos said the mayor will be asked by the police Criminal Investigation and Detection Group (CIDG) about the presence of armed men in his house.

“We will trace the guns, the guns registered under his name should be at his house,” Carlos said.

Espinosa appeared before the CIDG yesterday, with his lawyer Romeo Esmero speaking on his behalf.

Esmero denied the armed men killed in the mayor’s house were his bodyguards.

The mayor never tolerated his son Kerwin’s forays into illegal drugs, the lawyer said.

Esmero also denied the mayor was involved in drug trafficking.

An emotional Espinosa, for his part, pleaded to his son to surrender, saying the PNP chief has given assurance to assist them.

“Kerwin please surrender. PNP chief Dela Rosa promised to help you,” Espinosa told reporters after he gave his statement before the CIDG in a closed-door meeting.

Carlos said authorities are looking into reports the younger Espinosa has already fled the country. There were reports that Kerwin underwent plastic surgery to change his facial appearance to evade arrest.

Reports said Kerwin left for Kuala Lumpur, Malaysia last June 21 on Cebu Pacific flight 5J501.

The Espinosas have been linked to major drug trafficking in Eastern Visayas.

Dela Rosa said Mayor Espinosa had been listed in police records as a “drug protector” whose son controlled the narcotics trade in the region.

The mayor was the second high-profile drug suspect to turn himself in after being accused of drug-related crimes by Duterte.

Another local official, Daanbantayan, Cebu Mayor Vicente Loot, was one of five police generals linked by Duterte to the illegal drug trade.

Loot is a retired police general who served as anti-narcotics unit chief of the Central Visayas regional police.

Loot denied the allegations of Duterte as well as reports linking him to Kerwin.

“I never knew him. I heard about him when I was Central Visayas (anti-narcotics) chief. I did not use him as an asset in illegal drugs,” he said.

President Rodrigo Duterte has given Mayor Rolando Espinosa of Albuera, Leyte and his son 24 hours to surrender over their alleged involvement in drug trafficking, Malacañang said Monday.

“Today, President Duterte demanded the surrender of Mayor Ronaldo  Espinosa Sr., of Albuera, Leyte and his son, Kerwin Espinosa, on the grounds of drug-trafficking and coddling, within 24 hours,” presidential spokesman Secretary Ernesto Abella said.

“Otherwise, an order of ‘shoot on sight’ will be given if they resist and endanger the lives of arresting police officers,” he added in a statement.

Reports say about P1.9 million worth of 237 grams of suspected shabu were recovered by authorities in a buy-bust operation last Thursday near the houses of the Espinosas.

Arrested during the operation were Mayor Espinosa’s two bodyguards and three employees.

A newspaper report earlier said Mayor Espinosa had gone on leave.

ALBUERA, Leyte — Two bodyguards of  Albuera Mayor Rolando Espinosa and his three employees were arrested during a buy-bust operation on Thursday afternoon where at least P1.9 million worth of shabu were recovered.

Four other suspects managed to escape after they went inside the house of Kerwin Espinosa, the mayor’s son, and locked the gate, the police said.

The house of Kerwin is located inside a gated compound where his father also lives.

Chief Insp. Jove Espinido, Albuera police chief, said they had no authority to barge into the compound after the gate was locked.

“We want a fair fight. We don’t want martial law,” he added. He did not say what his next legal move would be to compel the Espinosas to surrender the suspects.

The buy-bust operation was conducted about 5:30 p.m. on Thursday, at the tennis court near the houses of the mayor and his son at Sitio Tinago, Barangay Benolho in this town.

The Philippine Daily Inquirer tried to reach Mayor Espinosa but was told that he had gone on leave since last week.

Arrested during the operation were two of the mayor’s bodyguards – Jessie Ocares, 34; and Marcelo Adorco, 40 – and his three employees – Jose Antipuesto, Jeffrey Pesquera and  Ernesto Dumalat.

Antipuesto, 36, who took care of the mayor’s fighting cocks, was the target of the buy-bust operation after the police received reports that he was selling the illegal substance, said Espinido.

He said a poseur buyer bought P300 worth of shabu from Antipuesto.

When the undercover policeman announced it was a sting operation, several men at the tennis court scampered in different directions.

But the joint team of the local police and the Regional Police Safety Battalion was able to collar Antipuesto and four others.

Although Ocares and Adorco were armed, they didn’t put up a fight.

Four men managed to escape by seeking refuge to the house of Kerwin.

Seized from Ocares were a .45-caliber pistol and a pack of shabu weighing 84 grams. A .45 caliber pistol and a packet of shabu weighing 121 grams were recovered from Adorco.

At least 14.8 grams of shabu were recovered from Antipuesto.

Pesquera, 39 and a native of Cebu City, also worked for the mayor as caretaker of his fighting cocks.  Shabu was also found in his possession.

Dumalat, 20, and another employee of the mayor, was caught with two small packs of shabu weighing 3.7 grams.

The suspects denied owning the shabu recovered from them.  All in all, the packets of shabu would reach P1.9 million in street value.

Adorco and Ocares said guns seized by the police were covered by licenses and a permits to carry firearms.

The five were detained at the Albuera police lock up cell pending filing of charges for violating the Comprehensive Dangerous Drugs Act of 2002 (Republic Act 2002).

In a press conference last Wednesday, July 20, Ombudsman Conchita Carpio Morales expressed her disappointment over the SC’s ruling.   A retired SC justice herself, Morales said that there was ample evidence presented by the Office of the Prosecutor to prove that the plunder charges against Macapagal-Arroyo are true.

“We are able to present strong evidence of 630 plus documentary exhibits, testimony of so many witnesses…as well as 40 plus folder records of the case,” Morales said in a report by the Inquirer.  “To us these are exhaustive records which reflect that the prosecution was able to prove [guilt] beyond reasonable doubt.”

President Duterte warned city mayors, Chinese nationals, PNP and BJMP personnel in relation to his unrelenting campaign against drugs. The former Davao city mayor named 5 police generals as the protectors of drug lords. He also named the top personalities involved with the Asian drug TRIAD. Bilibid prisoners Peter Co (in charge of Luzon and Metro Manila) and Herbert Colangco (in charge of Mindanao) allegedly run the illicit trade while confined at the national penitentiary. Peter Lim alias Jaguar, in charge of the Visayas and a Chinese national, is reportedly out of the country. Retired PNP General Marcelo Garbo is said to be a level 5 TRIAD member while the rest of the previously named generals and still to be named PNP officers are lower in the TRIAD organizational chart.

On the local government unit (LGU) level, Ozamiz City mayor Reynaldo “Aldong” Parojinog Sr., is reportedly the father-in-law of Mindanao Island TRIAD top brass Herbert Colangco. Mayor Parojinog’s daughter, Nova Princess, is the city vice mayor while her brother Ardot is an Ozamiz City councilor. Mayor Parajinog and Councilor Parajinog are the suspected drug lords in Ozamiz City, Misamis Occidental Province and the whole Mindanao Island. MANILA, Philippines — President Rodrigo Duterte on Tuesday named five high-ranking officials allegedly involved in illegal drugs.

In his speech at the 69th anniversary of the Philippine Air Force (PAF), Duterte warned officials involved in illegal drugs and named PNP Deputy Director General Marcelo Garbo Jr., former National Capital Region Police Office chief Director Joel Pagdilao, Western Visayas regional director Chief Superintendent Bernardo Diaz, Quezon City Police District director Chief Superintendent Edgardo Tinio and retired police general Vicente “Vic” Loot.

“I’d like to name publicly General Marcelo Garbo, he was a protector of the drug syndicates in the country; General Vicente Loot who is now the mayor of one of the municipalities of Cebu; General Diaz, the former regional director of Region 11; General Pagdilao, former regional director NCRPO; General Tinio former QCPD director,” Duterte said.

“As this time I order them relieved from their assignments and report to the director general. I would like to talk to them but certainly, I would expect the police commission to talk to them. Imbestigahan ninyo ito… hanapin ninyo ang totoo,” he added.

Duterte said the officials committed treason after the country spent for their uniform and education. He added he does not usually humiliate officials but he felt the need to speak the truth.
“I have to tell you the truth and the truth is after so many validations even when I was a mayor of Davao City lumalabas na itong mga pangalan na ito at nakikita mo na ang mga iyon intensive identification of the criminal syndicates and drug distribution marami ng namamatay at marami pang mamamatay at wag kayong sumali diyan maski pulis kayo because you will place yourself in the line of fire,” he said.

Duterte veered away from his prepared speech for the PAF anniversary as it was “all motherhood statements.” Instead, he proceeded to his extemporaneous speech about corruption, illegal drugs, criminality.
He also stressed that his campaign against drugs would continue.
“I may not be able to clean it three to six months, but by six months and one day medyo tapos na.”

Bernardo Diaz

Chief Superintendent Bernardo Diaz was appointed director of Police Regional Office 6 of Western Visayas by then PNP officer-in-charge Deputy Director General Leonardo Espina in June 2015. He replaced Josephus Angan who was retiring from service. Before the appointment, Diaz was deputy director of the Cagayan Valley Police Office. In April this year during the campaign period, Diaz was among the four police officials allegedly seen in the company of men linked to Liberal Party presidential candidate Mar Roxas. Diaz called the allegations malicious. Last week, Diaz was among the casualties of the PNP revamp led by newly appointed Director General Roland “Bato” Dela Rosa.

Marcelo Garbo

Former PNP deputy director general Marcelo Garbo Jr. retired in March after reaching the mandatory retirement age of 56 years old. Garbo was a contender for the PNP top post after the resignation of former PNP chief Alan Purisima but former President Benigno Aquino appointed Ricardo Marquez. Garbo openly supported the presidential bid of Liberal Party’s Mar Roxas. Last April, four police generals in active service were seen in the company of Garbo and a staff of Roxas. The police generals may face charges of electioneering or violation of the PNP ethical standards for meeting with Roxas supporters. Cerbo belongs to the Philippine Military Academy Class ’84, where Roxas was adopted as a mistah or classmate.

Vicente Loot

Retired police general Vicente “Vic” Loot was elected as mayor of Daanbantayan, Cebu in the May 9 elections. Loot won over former Mayor Augusto Corro by a slim margin of seven votes. This prompted Corro to file an electoral protest against Loot. The Daanbantayan mayor retired from the PNP on July 2015 after serving the police force for 37 years. He last held a directorship post at the PNP Training Service.

Joel Pagdilao

National Capital Regional Police Office Director Joel Pagdilao served as Quezon City Police District director before taking over as Metro Manila police chief. Pagdilao was among the four police generals who were not given specific assignments since new PNP chief Rosa took command last week. Along with Cerbo, Pagdilao was also seen in the company of Roxas at a hotel in Quezon City. He also belongs to PMA Class ’84.

Edgardo Tinio

Chief Superintendent Edgardo Tinio was director of the Quezon City Police District just two weeks ago reported hundreds of individuals confessing to the use and sale of illegal drugs a few days before Duterte assumed office. Tinio said the surrender of the suspects was through Oplan Katok, an operation wherein cops worked with barangay officials to win over residents linked to the drug trade. He was named chief of Quezon City police in July 2015, before which he was director of Pampanga police. He was also assigned at the Directorate for Integrated Police Operations in South Luzon.

As of press time, Diaz, Loot and Tinio have denied the allegations of the president in connection to their involvement in illegal drug trade.

DAVAO CITY – President-elect Rodrigo Duterte has tagged 35 local executives who are allegedly part of illegal drug networks that he plans to eliminate nationwide.

The maverick president “named names” before Congressional leaders, and said he will ask these elected officials who are also drug offenders to vacate their posts immediately.

“Parang binibigyan nya ng leeway ngayon na confess. Siguro lighter sentence dahil nagconfess ka na pero he is not saying clemency or pardon,” Quezon Representative Danilo Suarez told ABS-CBN News.

Suarez declined to name the 35 local leaders mentioned by Duterte, but hinted that these could be mayors or governors.

Duterte also told solons that he intends to clean the ranks of the Philippine National Police as some of its members have been lured into the illegal drug industry.

“He even mentioned that he might need the support of the Armed Forces in the cleansing method, eliminating those men in uniform who are involved in this drug issue,” Suarez said.

The 71-year-old Davao mayor previously called on three drug-tainted PNP generals to step down from their posts before the Duterte administration formally takes office on June 30.

Reiterating his vow to implement President-elect Rodrigo Duterte’s plan to wipe out the illegal drug trade in the country, incoming Philippine National Police (PNP) chief Ronald “Bato” Dela Rosa warned mayors who coddle drug lords in their area that they will be treated just like any other criminal.

“We will treat them like ordinary criminals. They committed a crime. I don’t care if you’re a mayor. You were elected using your drug money,” the Philippine Daily Inquirer quoted him as saying.

Dela Rosa also assured that these officials who will be caught red-handed won’t be afforded any special treatment.

“There would be no special treatment. How could you give someone a special treatment when he has committed a graver sin against the country because he was chosen as a mayor yet he has served as the drug lord in their area? He has committed a graver sin, right? So we would give you an ordinary criminal treatment? You might as well leave your post,” he said.

As a way of strengthening the PNP to help in Duterte’s anti-crime drive, Dela Rosa said he would appoint 15 new regional directors who won’t be afraid to defy local officials who are coddling drug lords.

“Our drug problem worsened because many of our commanders are afraid to go against the drug lords. They say that they have the protection of the mayor, governor or congressman. I would assign people who won’t be afraid to go against the drug lords,” he said.

Now having a SUPER MAJORITY in the House of Representatives and the Senate, a CERTIFIED URGENT BILL from the Office of the President should have smooth sailing in Congress. In other words, we could be seeing the return of the Death Penalty in a few months. The new Death Penalty Law (assuming the bill is passed into law) can not be used retroactively. In other words those previously sentenced for HEINOUS CRIMES can not have their sentences upgraded from a LIFE SENTENCE to a Death Penalty. Therefore, the first Death Sentences can only be promulgated AFTER the Death Penalty Law is passed and published in the OFFICIAL GAZETTE. This means only cases currently pending in court, as well as future cases, can and will be ELIGIBLE for the DEATH PENALTY. This recent Quezon City multiple robbery with rape cases could very well qualify as having fulfilled the criteria for the Death Penalty.

First, deceit was used in luring the two robbery rape victims. The perpetrators presented themselves as legitimate operators of a vehicle for hire. Two, the use of a vehicle in the commission of a crime is an AGGRAVATING CIRCUMSTANCE. Three, the fact that more than one person committed the crimes would fulfill the definition of RAPE IN BAND, another AGGRAVATING CIRCUMSTANCE. Four, the criminals came prepared with materials to tie the hands of the victims at the back. This is an indication of PREMEDITATION, which means that the crimes were planned well in advance. One suspect, Wilfredo Lorenzo, is now in police custody while another, only identified as “Buddy” is still at large.

Treason Case, Not Libel Suit, Will Be Filed Against Trillanes

Libel is easy to defend against. TREASON is INDEFENSIBLE in the case of Trillanes who admitted to back door talks with a foreign power (China). Trillanes LEAKED the possible response of the Philippine President (Aquino) which is/was basically to do NOTHING except to bring the Philippine Sea case to the international court. Equipped with the Trillanes INTELLIGENCE REPORT, China was EMBOLDENED to built structures (including air strips) in the contested areas because it already knew, based on consultations with Trillanes, that the Philippines WOULD NOT MOUNT a MILITARY RESPONSE. Thus Trillanes and Aquino acted as FOREIGN AGENTS of CHINA to the detriment of the Philippine claim to the West Philippine Sea. OCCUPATION is already 90% of contested ownership since we would still have to drive China away even if we win the international litigation. China does not recognize our international court case and even if it did, China would resort to legal measures to hold on to the land and sea lanes for ever. Aquino planning MARTIAL LAW to stay in power

Facing INEVITABLE defeat of his official candidate Mar Roxas and his alternate candidate Grace Poe, President Noynoy Aquino is planning to declare MARTIAL LAW to stay in power. In 1972, President Ferdinand Marcos, barred by the Constitution to run for a third four-year term in 1973, declared martial law which led to the capture and detention of Senator Ninoy Aquino, the father of the current president, P-Noy. Today, the shoe is on the other foot, President Aquino is barred from running for a second six-year term. PLUNDER and other charges are poised to be filed against President Aquino on July 1, 2016, one day after a scheduled turnover of office to the incoming President who would win the May 9 elections. The President of the Philippines is immune from lawsuits thus the need for him to step down before charges are filed against him. PLUNDER is a NON-BAILABLE offense thus almost guaranteeing PRISON TIME for P-NOY while awaiting and undergoing trial. Two immediate past presidents, President Joseph Estrada and President Gloria Macapagal Arroyo were both charged in court after their terms of office expired. Estrada was charged and CONVICTED but was pardoned right after he was found guilty. He, however, spent years in jail (actually a forced vacation) or hospital arrest before his trial ended. Arroyo was charged and is still in jail (for years now) because her trial has barely moved. Presidential candidates Poe, Binay and Duterte have publicly stated that they would allow, or at least, not block court decisions that would order to place the former President, GMA, on house arrest rather than her current hospital arrest.

As GMA prepares to leave hospital arrest, P-Noy would most probably be taking her place in JAIL. With exactly a week left before the May 9 elections, a DESPERATE Aquino Administration is seeing the writing on the wall, an ELECTORAL ROUT of the Aquino candidates (Roxas and Poe). DESPERATE times call for DESPERATE measures and thus the perfectly legal solution of declaring MARTIAL LAW has crossed the minds of the soon-to-be outgoing  government. Most political analysts PREDICT MASSIVE CHEATING in the elections with Mar Roxas being declared the winner (shades of 1986). As what happened in EDSA1, people are expected to take to the streets in protest. A stalemate would occur (ala EDSA1 and EDSA2) which would finally be resolved by PEOPLE POWER toppling the government. The problem with both EDSA1 and EDSA2 was that both governments fell (Marcos and Estrada) so the current Aquino Administration is cognizant of the lessons of the past. Had Marcos intervened earlier as in the night of February 22, 1986 or the early morning of February 23, when the number of protesters had not yet grown to huge proportions, the dictator could have retained power. Assuming, the Aquino government would want to make a PRE-EMPTIVE MOVE (actually a COUP), they would STRIKE on May 9, 2016 as thousands of voters realize that their voting RECEIPTS do not match the candidates they voted for. Anger outside of the polling precincts would be interpreted by the powers that be as UNCONTROLLED VIOLENCE (after a number of planted harmless explosions are conveniently heard in different places) thus “FORCING” Aquino to call in the military to quell the disorder. Martial Law would then be declared due to the popular uprising. Since there will be no election results forthcoming, Mr. Aquino has to stay in power in a holdover capacity until a future election is scheduled. Protesters would, of course, be dealt with in the hope of BREAKING the WILL of the opposition during the duration of martial law (which would only be lifted once Aquino is fairly confident that his candidate, not necessarily Mar Roxas, would win the next time around).

If Aquino can not execute this May 9 plan, he would suffer from a loss of the SURPRISE FACTOR since everyone would be watching out for his every move and that a rush to assume emergency powers would be looked upon as a BLATANT STEP to RETAIN POWER. With each and every passing day that comes along, the Constitutional process of a peaceful transition to a new President would materialize and after July 1, 2016 the fate of ex-President Aquino would be in the hands of the courts (unless he is otherwise disposed of by MOB RULE or a military COUNTER COUP).
