Supreme Court CJ Sereno on FORCED INDEFINITE LEAVE pending IMPEACHMENT

As the House Committee on Justice winds up hearings on the Supreme Court Chief Justice Sereno IMPEACHMENT CASE, there is a simmering disappointment among Associate Justices on how CJ Sereno is keeping her opinions to herself and not coming out clean on the SALN (Statement of Assets and Liabilities) issue. The next step in the impeachment process would be a vote in the House of Representatives in plenary session. Since the Administration Coalition has a super majority in the Lower House, it is almost a certainty that the minimum of at least one third of Congressmen/women voting for IMPEACHMENT would easily be breached. Should this happen, probably next week, then CJ Sereno would be considered IMPEACHED. Her trial would be conducted at the Senate and a guilty verdict would remove her as Chief Justice and from the Supreme Court. Former Chief Justice Renato Corona was previously IMPEACHED and found guilty by the Senate Trial Court thus removing him from office. Corona, who died in 2016, had the support of most of the Associate Justices and Supreme Court employees all throughout the trial which is not the case with the sitting CJ Sereno where current and former Supreme Court Associate Justices have testified AGAINST her in the House investigation.

Why SC justices forced Sereno to go on leave

Chief Justice Sereno’s official letter regarding her leave is anticipated. Will it settle things for now, or will it cause more trouble in the Supreme Court?

The tipping point came last Tuesday, February 20, when the Supreme Court (SC) en banc received official communication from the House of Representatives which raised issues surrounding the alleged missing Statements of Assets, Liabilities, and Net Worth (SALNs) of Chief Justice Maria Lourdes Sereno.

Suddenly, the en banc was confronted with a situation where a co-equal branch was asking them something they did not know the answer to. There were allegations the appointed Chief Justice did not comply with requirements for her appointment.

That Tuesday, the en banc required Sereno to explain herself, at the very least, to them.

Sereno had not yet responded with an explanation. Between February 20 and the next en banc session, Tuesday, February 27, the animosity grew more intense.

On February 27, justices – except for Associate Justice Benjamin Caguioa who was on leave – reportedly reached a consensus and forced Sereno to take a leave. Her camp came out with its own version of events, saying that she had just decided to advance a previously scheduled “wellness leave”. This agitated the justices who felt that she backtracked on her word.

‘Lost respect’

That Sereno has refused to explain the SALN issue, among other things that concern the court, was taken as an affront to the en banc, a court insider said.

“This is no longer an issue of legality but an issue of respect,” said one justice during the heated exchange during the en banc session on Tuesday.

Two justices said they did not actually have a uniform or set agenda coming to the en banc on Tuesday; “Nagpapakiramdaman ang lahat (Everyone was trying to get a sense of what everyone else was up to).”

It was Associate Justice Samuel Martires who spoke first, asking Sereno to explain the SALN issue.

One justice said: “You are speaking with your peers and I think you owe us the courtesy of explaining yourself.”

Another justice asked Sereno: “You freely speak to the media to explain yourself but you cannot come clean with your colleagues?”

Throughout all their questions, the insider said Sereno stuck to one answer: “In two months you will see my defense,” referring to the trial at the Senate.

Martires dared Sereno: “Gusto mo mag-resign tayong dalawa? You want us both to resign?”

Other justices tried to cool the heated emotions, until one justice expressly told Sereno to just take an indefinite leave to allow the SC breathing room.

“Employees have been restive,” a Supreme Court source said.

Why the leave?

Three well-informed sources at the High Court said that the wisdom behind the request for an indefinite leave was to make sure the court preserves evidence and removes undue influence on witnesses and other involved officials.

It would also allow the remaining justices to assess the evidence before them and take the necessary steps to “exact accountability to the institution,” one justice said.

Martires reportedly said: “I love this institution, I have been serving the institution for the past 17 years. I will not allow the two political branches to interfere in the independence of the judiciary, because that will imperil democracy. Let the cleansing start from within.”

“It’s not easy for me, but I always do what I think is right even though it is difficult,” Associate Justice Marvic Leonen was reported to have said during the session.

There was a consensus among all 13 justices to ask Sereno to go on leave starting Tuesday, February 27. But the Chief Justice was intransigent and reportedly volunteered to take her wellness leave instead. Justices remained firm in their request for her to take an indefinite leave.

Sereno asked for a 10-minute recess. When she returned, she announced to the en banc: “Starting Thursday, I am taking my indefinite leave of absence. I wish to attend the division hearing on Wednesday. All items on the agenda today shall be called again next week,” a court source quoted her as saying.

‘She lied’

After two long hours, the session ended and justices went back to their chambers.

When they tuned in to the news, they learned that Sereno’s spokesperson announced that the Chief Justice was taking her wellness leave early, contrary to the indefinite leave that was agreed upon by all, including Sereno herself.

That again riled up the justices.

“She lied again,” one justice said.

“She’s deceptive,” another said.

Another one said: “She’s courting trouble.”

On Wednesday morning, February 28, Sereno is expected to file a letter with the High Court to make her leave official.

What will she say in the letter? Will she say “indefinite leave” as reportedly agreed upon in the en banc, or will she say “wellness leave”, as Sereno’s spokesperson had announced?

In the Senate investigation on the PCSO and Small Time Lottery, PCSO Director Sandra Cam revealed that PCSO STL franchisee Samuel Aguilar is also the JUETENG kingpin of the area while hiding under STL Identification Cards to avoid arrest for the illegal numbers game which rakes in the bulk of the money while reporting only minuscule amounts for the government-run gambling component.

Cam mentioned that Samuel Aguilar used to work in the New Bilibid Prisons under General Vinarao. Aguilar was able to establish business links with high profile convicted DRUG LORD Peter Co as well as Peter Lim. Cam revealed that Aguilar was the major supplier of Visayas DRUG LORD Melvin “Boyet” Odicta Sr. (killed together with his wife in 2016). Cam stated that Aguilar is the current overall head of operations of the ILLEGAL DRUG TRADE (SHABU) in Antique Province, Iloilo City and North Cotabato. Aguilar is also supposedly close to former Iloilo City Mayor Jed Mabilog (a cousin of Senator Franklin Drilon). Mabilog was named by President Rody Duterte as the DRUG LORD protector of Iloilo City. He has since been removed from office and fled to the United States for medical reasons and has not returned to face prosecution.

As an STL franchisee, Aguilar used to frequent the office of PCSO General Manager Alexander Balutan (the main opponent of Sandra Cam in the PCSO).

Malacañang on Monday said Senate Minority Franklin Drilon should be investigated following the revelation of alleged “pork barrel scam” mastermind Janet Lim Napoles that the lawmaker received millions of pesos in campaign donations during the 2010 elections.

Palace spokesman Harry Roque Jr. was reacting to Napoles’s statements, made during an interview with broadcaster Erwin Tulfo, aired live over government-run dzRB radio station on Monday.

In a text message, Roque said Drilon was not exempted from investigation over allegations of corruption.

“Leave it to DoJ (Department of Justice) but there should be an investigation,” Roque said when asked about Napoles’ allegations against Drilon, a stalwart of the erstwhile ruling Liberal Party.

“Yes, si Sen. Frank Drilon (It’s Sen. Frank Drilon),” she added, when asked to confirm if she was referring to the opposition senator.

Drilon has yet to comment on Napoles’ allegations.

Earlier, Justice Secretary Vitaliano Aguirre 2nd floated the possibility of turning Napoles into a state witness in a new inquiry into the P10-billion priority development assistance fund anomaly.

 

President Rodrigo Duterte had said Napoles was just a “minimal player” in the pork barrel scam.

Napoles was offered to turn state witness after she was acquitted by the Court of Appeals in the serious illegal detention case filed against her by her second cousin, pork barrel whistle-blower Benhur Luy.

She, however, remains detained as she is still facing plunder charges before the Sandiganbayan, along with her co-accused former senators Juan Ponce Enrile, Jose “Jinggoy” Estrada and Ramon Revilla Jr.

“Let the process of accountability begin!” the Palace official added.

During the intervview, Napoles claimed that she gave money to Drilon for the 2010 polls.

“Kilala niya po ako at sa katunayan po nagbigay po ako ng donations nu’ng election, nu’ng tumakbo po siya nu’ng 2010 elections. P5 million po (He knows me and in fact I gave him donations during the elections, when he ran during the 2010 elections. It’s P5 million),” Napoles said.

On the 72nd founding anniversary of the Liberal Party (LP), former President Benigno Aquino III predicted that the former ruling party would soon rise again.

“Maski na matagal-tagal na tayong binubugbog, mukhang malapit na ho tayong buumangon at pabugbog muna. Mas maliwanag ‘yung bukas dahil nandito kayong lahat,” Aquino had said during the Friday evening celebrations.

GMA 7 news program “24 Oras Weekend” reported that Vice President Leni Robredo was also at the event, during which she urged party mates not to lose hope.

“Maraming nagsasabi na saan ba tayo patutungo? Marami ‘yung nagsasabi binabali tayo ng kadiliman pero sana po huwag tayong mawalan ng pagasa,” said Robredo.

In a statement, Ifugao Representative Teddy Baguilat Jr. said that 500 new LP members took their oaths Friday night in simultaneous ceremonies in Manila, Cebu, and Naga.

“These are all card-bearing, committed, non-politician Liberals,” said Baguilat, who led the oath-taking in Naga.

“Many of them applied through the party’s newly launched online recruitment platform. They are a mix of professionals, from various sectoral groups, millennials, seniors, etc. who are fed up with this administration’s abuse of power, and who are looking for a space to come together and resist,” he added.

Senator Francis Pangilinan, meanwhile, led the LP celebrations in Cebu City.

“Habang ang ilang kasamahan o kababayan natin, mga pulitiko at iba pang mga grupo ay paalis at lumilisan at iniiwan ang Partido Liberal, hindi totoong tayo ay mawawala,” said Pangilinan.

“Tayo sa Liberal Party, we have been through hell and back. And we in the Liberal Party, to borrow and paraphrase the words from the poet Dylan Thomas: ‘We will not go quietly into this dark night,’” he added.

MANILA – (UPDATE) The Mayon Volcano shot what appeared to be a huge ash column on Monday, the second in over a week and as authorities braced for a possible “hazardous eruption.”

Some 27,000 people have been evacuated around the volcano that is renowned for its perfect cone.

The alert level was raised to level 4, one notch below the highest warning. This indicates a “vulcanian eruption” is ongoing.

Alert level 3 was raised over the volcano on Jan. 14. It is the third highest in a five-step warning system.

Mayon draws thousands of tourists, even during minor eruptions, rises 2,460 metres (8,070 feet) above a largely agricultural region some 330 kilometres southwest of Manila.

It is considered the nation’s most active volcano.

Steam-driven eruptions and rockfalls began earlier this month, and the crater began glowing soon after, in what Phivolcs said was a sign of the growth of a new lava dome.

DFA opens more slots for passport application

MANILA, Philippines — The Department of Foreign Affairs (DFA) will increase passport application slots and boost its capacity in the coming months to address the huge backlog.

In a press conference in Pasay City yesterday, Foreign Affairs Secretary Alan Peter Cayetano also denied that a syndicate involving some DFA personnel and travel agencies is behind an “extortion” operation, referring to the P5,000 fee collected from applicants who want to get a passport appointment at an earlier date.

He said the DFA has removed since last year the reserved slots allotted for travel agencies. It was during that time, he added, that the selling of appointment slots was possible because the travel agencies were allotted 1,200 slots a day.

“We’re not saying it’s impossible that there are fixers who claim (now) that they have slots. Anybody can say anything. What I’m saying is they (travel agencies) have no reserved slots, so they can’t sell anything to you,” Cayetano explained.

The DFA also designated special lanes for overseas Filipino workers (OFWs), pregnant women, people with disability, children below seven years old and solo parents who are applying for passports.

“The key is to increase the capacity. If we have increased capacity there’ll be no problem,” the secretary said, noting that the agency is facing a backlog of 400,000 to one million passports.

Cayetano led yesterday the launching of the new Philippine passport with 10-year validity at the DFA-Office of Consular Affairs in Parañaque City.

President Duterte signed in August last year the law extending the Philippine passport validity to 10 years, doubling its previous lifespan of only five years. However, applicants aged 18 years and below will continue to be issued the five-year passports.

This was newly-appointed Department of the Interior and Local Government (DILG) undersecretary Martin Diño’s new directive to barangay (village) officials as he vowed to step up their involvement in the government’s massive campaign against illegal drugs.

“I will make sure that all the barangays all over the Philippines will be fighting against illegal drugs,” Diño said in an ambush interview on Tuesday.

Diño was present at the turnover ceremony of the now Dangerous Drugs Board (DDB) chairman Catalino Cuy to the newly-minted DILG officer in charge Eduardo Año at the DILG National Police Commission (Napolcom) in Quezon City.

“I will ask all the barangays to submit a list of suspected drug pushers, suspected criminals in their respective barangays. This time, may sanction kapag hindi nakapagsubmit (if they don’t submit),” Diño said.

He said he will consult his legal team about the sanctions the DILG could impose against non-compliant barangay officials.

President Rodrigo Duterte on Monday appointed the former Subic Bay Metropolitan Authority (SBMA) Chairman four months after he was replaced by appointed lawyer Wilma Eisma as both SBMA chairman and administrator. /je

 

 

Dengvaxia Vaccine Deaths

The Department of Health has recently informed manufacturer Sanofi of its plan to return about a BILLION pesos worth of the UNUSED vaccine doses (a total of PHP 3 BILLION worth was purchased by the Philippine government). The National Bureau of Investigation and the Public Attorney’s Office are conducting exhumations and autopsies of previously vaccinated children who may have died of DENGUE LIKE symptoms (usually bleeding in the intestines, brain, heart and lungs) in an effort to prove that the vaccine, indeed, caused the deaths (directly or through the exacerbation of what was supposed to be a lesser gravity of the clinical course).

At least 7 autopsies have been done on the current total of 14 suspected deaths. The public has already been informed to report other possible cases so that the proper examinations and verification can be performed.

Death of 5 children linked to Dengvaxia

SAN PEDRO CITY — Officials in Cavite and Laguna provinces are monitoring the health of thousands of schoolchildren who have been inoculated with Dengvaxia after forensic experts from the Public Attorney’s Office (PAO) reported having found a “link” between the deaths of five children and the controversial dengue vaccine.

Dr. Erwin Erfe, director of the PAO Forensic Laboratory, said on Wednesday that the latest to be subjected to forensic examination was the body of a 13-year-old boy who died in Bulacan province on Jan. 3.

The forensic examination was conducted in Sampaloc, Manila, on Wednesday morning with consent from the boy’s parents, he said.

“[W]e found massive bleeding in the brain. There’s a lot of blood in the scalp, [in] the heart, lungs and in the stomach,” Erfe said in a phone interview.

Earlier, Erfe said the examiners had observed a pattern in the death of five children who had been inoculated with Dengvaxia.

The PAO on Tuesday examined the body of an 11-year-old boy from Bataan province. Erfe said the boy died “within 12 hours” of developing headache and fever.

Among the bodies examined by the PAO experts were those of Zandro Colite, 11, from Cavite, and Lenard Baldonado, 10, from San Pablo City in Laguna.

Baldonado’s body was exhumed and subjected to forensic examination on Jan. 7 in San Pablo.

The PAO experts also found bleeding in the lungs and enlarged organs in Baldonado’s case.

Dr. Nelson Soriano, the provincial epidemiologist of Cavite, said Colite’s death certificate indicated that he died from ruptured appendix last Dec. 27.

P3.5-B immunization program

Soriano confirmed that Colite was among the schoolchildren inoculated with Dengvaxia  under a Department of Health (DOH) P3.5-billion immunization program that had been run with the Department of Education.

The DOH halted the immunization drive last Dec. 1, three days after Sanofi Pasteur, the French pharmaceutical company that developed Dengvaxia, announced that the vaccine worsened symptoms in vaccinated people who had no previous exposure to the dengue virus.

More than 830,000 schoolchildren had already received at least one dose of Dengvaxia before the DOH stopped the immunization program.

In Cavite, records from the provincial health office showed that 68,366 schoolchildren had received the first dose of Dengvaxia, while 37,966 had received the second dose and 36,860 had completed the three doses.

Soriano said the health of the children was being monitored. So far, he said, Colite’s case was the only one in the province linked to the controversial vaccine.

In Laguna, thousands of schoolchildren aged 8 to 14 also received the vaccine between 2016 and 2017.

Dr. Rene Bagamasbad, the Laguna provincial health officer, said many more received the vaccine at private hospitals, Baldonado most likely among them because his name did not appear in the records of the government’s immunization program.

Aside from Baldonado’s case, Bagamasbad said an 11-year-old boy from Lumban town who received the full dose of Dengvaxia was hospitalized from Dec. 10 to 15, 2017, after showing symptoms of dengue. The child survived.

Enlarged organs

On Tuesday, Erfe said the children who fell ill after receiving Dengvaxia suffered from internal bleeding and enlarged organs and all died six months after they had been inoculated.

Among those examined were 10-year-old Anjielica Pestillos, who died last Dec. 15.

Erfe said the death certificate showed Pestillos died of systemic lupus erythematosus or autoimmune disease.

But initial forensic examination showed she had an enlarged liver, which weighed more than a kilo—not normal for a 10-year-old, Erfe said.

He said the girl also had enlarged kidneys and spleen.

Erfe said the children died soon after they showed symptoms of severe dengue.

Severe dengue

The latest to be examined were 13-year-old Rei Jazzline Alimagno and 11-year-old Alexander Jayme, Erfe said.

Alimagno died of dengue shock on Jan. 3 while Jayme died of septic shock on Jan. 4, he said.

Both children received Dengvaxia six months earlier.

Erfe said both showed symptoms of severe dengue and while their organs were normal in size, they had suffered from bleeding in the brain.

Jayme, he said, had suffered from bleeding not only in the brain but also in the stomach, lungs and liver. Even the boy’s scalp showed traces of blood, he said.

Dengue patients

On Tuesday, PAO chief Persida Rueda-Acosta reported that 21 people, including a 15-year-old pregnant girl, were taken to Philippine Children’s Medical Center in Quezon City with dengue symptoms.

“They all have fever and rashes and they were all inoculated with Dengvaxia,” Acosta said.

Health Secretary Francisco Duque III said on Wednesday that the DOH welcomed the PAO investigation, and offered to “extend any help in unveiling the truth.”

“Our panel of independent experts and the Philippine General Hospital have been tasked to monitor adverse events following immunization. We see [the] PAO’s efforts as complementary to our own and we would like to see the results of their probe,” Duque said. —With reports from Tina G. MANILA – Contrary to the pronouncements of Justice Secretary Leila de Lima, lawyer Levito Baligod said there is enough evidence on the misuse of funds of the defunct National Agribusiness Corp. (Nabcor).

Speaking to radio dzMM, Baligod said the DOJ and National Bureau of Investigation (NBI) never conducted an investigation into the alleged anomaly, wherein acting Health secretary Janet Garin was accused of receiving pork barrel kickbacks in 2007.

“The NBI or DOJ never conducted an investigation. They just allowed the documents we filed slip into their office and after two months, saka pa lamang nila tinransmit sa Office of the Ombudsman,” Baligod, former lawyer of whistle-blower Benhuy Luy, told dzMM.

”Wala akong nakikitang basehan na wala kaming ebidensyang isinumite sa kanila.”

De Lima earlier said the NBI still needed to gather more evidence on the controversy, and for witnesses to submit more evidence.

Former Nabcor officials Victor Cacal and Rhodora Mendoza claimed that Garin accepted P1 million during the 2007 polls, along with 9 other politicians.

Garin has since denied the allegations saying, as member of the House of Representatives, she had no dealings with anyone from Nabcor.

Ginintuang Masaganang Ani

According to Baligod, the Department of Agriculture downloaded P300 million to the Nabcor for the Ginintuang Masaganang Ani (GMA) program, P105 million of which was meant for technical studies.

Baligod said no actual technical study ever occurred, and only Nabcor employees themselves prepared the reports.

He said the funds allotted for the technical studies were just deposited to the bank account of then Nabcor vice-president Elvira Castelo, upon the order of then Nabcor president Allan Javellana.

Castelo has executed an affidavit, wherein she admitted remitting the public funds to the her bosses at Nabcor and the DA, Baligod said. Part of these funds were then distributed to politicians, according to Mendoza.

”Sinumite namin ang print out ng bank entries noong bank account ni Mrs. Castelo at doon ipinakita namin ang mga pumasok na pera na ni-remit ng mga NGOs,” he said.

”Itong si Mrs. Castelo, meron siyang statement na inaamin niya na pinasok sa bank account niya ang mga pera at sinabi niya na siya ang nag-remit ng pera sa mga boss niya sa DA at NABCOR.”

Baligod said he received information that some of the documentary evidence in the hands of Nabcor, which was abolished earlier this year, were being kept inside a warehouse.

”Ayon kay former NABCOR President Honesto Baniqued, may opisyal na nautusan noon na itakbo ang ibang mga dokumento. Pero karamihan ng mga dokumento, nasa warehouse na tinutukoy nila,” he said.

”Kaya nagsaliksik tayo kung nasaan ang mga dokumento na dapat nasa kustodiya ng Nabcor. Napagalaman natin na tinago ng Nabcor officers sa isang warehouse na ang susi ng warehouse na iyan eh nasa kamay ng COA (Commission on Audit) at isang Usec. Umali ng DA.”

MANILA, Philippines – Whistleblowers who wanted to pin Acting Health Secretary Janette Garin on her alleged involvement in the anomalous use of millions of pesos in funds of the defunct National Agri-Business Corp. should submit more documents if they wanted the investigation to continue.

Confirming that the P5-billion Nabcor fund scam probe has been stalled at the National Bureau of Investigation, Justice Secretary Leila de Lima on Friday cited the need to gather more documentary evidence to boost the case against those suspected to be involved.

“If the witnesses have the documents being required of them, then the probe could proceed anytime,” she told reporters.

Garin was implicated last March by former Nabcor officials Rhodora Mendoza and Victor Cacal as among the lawmakers who allegedly benefited from the Nabcor funds intended to be used for “technical studies” for rice harvest improvement but ended up in the politicians’ campaign kitties instead.

Garin, who was named health undersecretary in 2013, has repeatedly stated that she was not involved in the scam and had no contact with Nabcor or anybody from the state-owned firm.

De Lima also confirmed that the NBI’s special task force has continued to be in charge of the fact-finding on the Nabcor scam but investigation has been delayed. She added that the NBI would resume its probe if the necessary documents were given by the whistleblowers.

“There were many documents asked from them (Mendoza and Cacal) that they failed to present,” the Secretary said.

The task force was the same team that investigated the P10-billion Priority Development Fund Assistance scam involving businesswoman Janet Lim-Napoles and other former and incumbent lawmakers and government executives.

De Lima said the NBI was initially uncertain about continuing with the probe after learning that the whistleblowers and their lawyer Levito Baligod had also submitted their affidavits to the Office of the Ombudsman.

“They first went to the Ombudsman before Attorney Baligod brought them to us. They showed certain documents, but I wasn’t sure if they officially subscribed to their sworn statements,” the Secretary recounted.

The whistleblowers claimed Garin and nine other politicians got up to P300 million from Nabcor funds sourced from the Ginintuang Masaganang Ani program of the Department of Agriculture.

Mendoza, Nabcor’s former vice president for administration and finance, alleged that she was ordered by then Nabcor president Alan Javellana to transfer the funds for the personal expenses of some politicians in the 2007 midterm elections.

At that time, Garin was an Iloilo congresswoman allied with then president and now Pampanga Rep. Gloria Macapagal-Arroyo.

Garin’s legislative district also cropped up as among the areas that benefited from the “fertilizer fund scam,” which involved the diversion of about P728 million to Mrs. Arroyo’s campaign fund during the 2004 election period.

The whistleblower, Jose Barredo Jr., had claimed that the scam, allegedly orchestrated by former agriculture undersecretary Jocelyn “Joc-joc” Bolante, included Garin’s husband, Guimbal town mayor Richard Garin, and her predecessor as congressman, her father-in-law in-law Oscar Garin, as the beneficiaries or conduits.

Charge Aquino, Garin and Abad

The Food and Drug Administration has ordered the recall of Dengvaxia, the world’s first anti-dengue vaccine, over concerns that it might put at risk those who do not have a history of dengue.

That is to be expected. Imagine 733,00 schoolchildren who have been immunized are all in danger after former President Benigno Aquino III and his health secretary, Janette Garin, went on a buying spree toward the end of the previous administration.

The recall of the drug should not make us complacent. The impact of this fiasco is so overwhelming.

We cannot rely on what the Sanofi representatives are saying. They are playing down the impact of the issue.

The Duterte administration should look into why and how this fiasco even happened. Those responsible should be made accountable.

Records show that Aquino met representatives of Sanofi Pasteur in Paris, twice. Soon enough, a deal was in place. Maybe Aquino wanted to show the people that he was doing something for the people. At that time, the 2016 election was looming large.

The drug was never certified by the World Health Organization. Now Sanofi tells us there are risks. This is just unacceptable!

The Duterte administration is now saying that in the wake of investigations scheduled by Congress and the Department of Justice, together with the National Bureau of Investigation, a refund of the P3.5 billion spent for the program should be sought. Parents of the children should file a class suit.

Considering the fact that it was BS Aquino who negotiated this deal that was later implemented by Garin, what must be done is as clear as day. And let us not forget former Budget Secretary Florencio Abad who released the money.

I am truly passionate about holding these people accountable for what they did. I am so worried about those children.

#DengGate: PNOY, GARIN, ABAD VIOLATED LAWS TO RUSH DENGVAXIA PROCUREMENT

In a ThinkingPinoy interview held earlier today at the Philippine Red Cross HQ, Senator Dick Gordon said:

1. Pres. Noynoy Aquino and Department of Health (Philippines) Sec. Janette Loreto Garin met Sanofi-Aventis in France on 01 Dec 2015.

2. Nine days later on 10 Dec 2015, Pnoy started looking for money to fund the Dengvaxia mass immunization program, even if the drug has yet to be approved for use in the Philippines.

3. Pnoy initially wanted P5 billion, but was only able to find P3.5 billion. It was taken from savings from the Miscellaneous Personnel Benefits Program,which was intended for retired personnel, in contravention of a February 2015 Supreme Court of the Philippines ruling on DAP, which prohibits the Executive Branch from reallocating savings.

4. Food and Drug Administration Philippines approved Dengvaxia on 23 December 2015, even if it still had no formulary, or an official list giving details of medicines that may be prescribed.

5. The Department of Budget and Management, though Sec. Butch Abad, summarily issued a Special Allotment Release Order (SARO) for 3.5 billion on 29 December 2015.

Sanofi’s Dengvaxia was later confirmed to worsen dengue symptoms for those who have not had dengue prior to vaccination, potentially endangering the lives of the 700,000 individuals, mostly 4th Grade children, who received Dengvaxia through the botched immunization program of the Aquino Government.
