Duterte slams media anew

President Duterte on Thursday pressed his attack on two big Philippine news organizations.
Mr. Duterte accused the Philippine Daily Inquirer of owing taxes to the government.

He also accused ABS-CBN television network of not returning the money he had paid for airtime that was never given to him during last year’s presidential campaign.

In a talk with reporters in Puerto Princesa City, Palawan province, Mr. Duterte said the Inquirer owned Dunkin Donuts, which he claimed had tax liabilities that were “fixed” by former Bureau of Internal Revenue Commissioner Kim Henares.

The Inquirer does not own Dunkin Donuts.

He said the tax deficiencies were not paid, or only a portion had been settled.

As for ABS-CBN, Mr. Duterte said he paid the network for airtime during the campaign, using money he received from donors when his ratings went up.

“You know that son of a bitch ABS-CBN, they accepted my money, they never showed my [advertisement]. Up to now, there was no offer to reimburse or to return the money. Those son of a bitch oligarchs are that shameless,” he said.

Mr. Duterte said ABS-CBN showed an advertisement, produced by his critic Sen. Antonio Trillanes IV, that used children to criticize him during the campaign.

He also noted that the Inquirer and ABS-CBN had reported on Trillanes’ allegations that he had more than P200 million in an undisclosed bank account, which he denied.

‘I don’t have that money’
Mr. Duterte challenged the two news organizations to look into his bank accounts.

“Now that I’m President,” he said, “I’m giving everybody the authority, including Inquirer and ABS,” to look into his bank records.

“I do not have that money. And if anybody can point to it, I will step down tomorrow as President of this republic,” he added.

Who is afraid of Dunkin’ Donuts?

IN her selective policy of running after alleged tax evaders to collect more money for the Aquino administration, Commissioner Kim Henares of the Bureau of Internal Revenue (BIR) busies herself issuing press releases.

She finds it more convenient to expose through the media those who have failed to declare their true taxable income. In one of her recent exposés, she took pride in going after a small company that she claimed the BIR has yet to collect a deficiency tax of P1.84 million, inclusive of surcharges and interests for taxable year 2002, which would make the original assessment too small for the public to appreciate in view of her uncollected billions.

But then, nothing may be small for Henares to go after as long as she succeeds in collecting funds for this administration, and even going to the extent of subjecting her targets to trial by publicity. Ironically, while she mourns over a P1.84-million tax deficiency, she seems to fear Golden Donuts Inc. (GDI), which, as the corporate name suggests, sells donuts. In fairness to her and the Aquino administration, she and her boss have only inherited from the previous Arroyo administration the task of either forcing collection from or suing GDI for alleged deficiency tax of P1.51 billion for taxable year 2007.

The huge unpaid tax of GDI resulted from alleged under-declaration of revenues discovered by Othello Dalanon, a former BIR examiner. Dalanon has resigned apparently frustrated over Henares’s refusal to either enforce collection or charge the company not only for nonpayment of correct taxes but also for fraud for under-declaring its revenues in its 2007 income tax returns.

Why didn’t the BIR under the previous Arroyo administration go after GDI when Dalanon’s examination of the company’s books began in 2008? The same question should be addressed to Henares and President Benigno Simeon Cojuangco Aquino 3rd, whose “matuwid na daan” is not straight after all. How come Aquino, the president, and Henares, his chief tax collector, remain sitting on Dalanon’s findings of tax deficiency and fraud against GDI?

Incidentally, since Henares and her President do not have the answer, Due Diligencer could only provide the readers of The Manila Times bits of information about GDI as they trickle in. Recently, it obtained the general information sheet (GIS) for 2007 the company submitted to the Securities and Exchange Commission (SEC). GIS is only one of a number of filings the SEC required for submission by stock corporations.

Among others, it lists a company’s officers and stockholders and their individual holdings.

In 2007, the SEC filing shows GDI had 13 officers and directors. Among them were Leopoldo Prieto, chairman; Walter Spakowski, president; Marixi Prieto, secretary; Miguel Prieto, treasurer; and Pedro Paraiso, chief financial officer. It also listed eight other officers without specific designations, namely, Ma. Pilar Prieto-Lorenzo, John Spakowski, Leopoldo Prieto 3rd, Paolo Romeo Prieto, Stephen Young, Cezar Corcuera, Ernesto. Co and Jocelyn Santos.

GDI had 45 stockholders whose investments amounted to P130.357 million in 2007, according to the same GIS but identified only 20 including corporate stockholders such LLP Enterprises, P35.08 million, or 26.91 percent; Marilex Realty Corp., P18.70 million, or 14.35 percent; Spare Enterprises, P4.69 million, or 3.60 percent; PAMM Inc., P2.36 million, or 1.81 percent; and Metro Bakers Inc., P2.362 million, or 1.81 percent. It also listed RCBC Trust Account as owner of P7.805 million, or 5.99 percent. Since the GIS shows only 20 owners, it is presumed that the rest were hidden under “others” who at No. 21, held 78,659 GDI shares, or 6.03 percent.

The individual stockholders complete the list of GDI’s stockholders in 2007. They were John Spakowski 2nd, P16.729 million, or 12.83 percent; Walter Spakowski, P11.694 million, or 8.97 percent; Richard Young, P3.903 million, or 2.99 percent; Jacinto Jimenez, P2.907 million, or 2 percent; Lucia Spakowski, P1.738 million, or 1.33 percent; Ma. Pilar Prieto-Lorenzo, Ramon Prieto, Eduardo Prieto, Carlos Prieto, Ma. Consuelo Prieto-Guerrero, Ma. Ines Prieto-Borromeo and Ma. Cristina Prieto-Moraza, P1.509 million, or 1.16 percent each; Pedro Paraiso, P2.776 million, or 2.13 percent; and Robert Spakowski, P1.474 million, or 1.13 percent.

For the information of Henares, all of the corporate and individual stockholders, along with GDI’s officers, listed “GDI Building, Reliance corner Sheridan Streets, Mandaluyong City” as their “current residential address.” If in the past, either she could not find them, perhaps, the information here should serve as lead where to find P1.51-billion dough for the government’s coffer.

DILG secretary dismissed over firetrucks deal

Interior Secretary Ismael Sueno lost his job because of a row with his three undersecretaries in the Department of the Interior and Local Government (DILG) over the right to sign contracts and promotions, according to a spokesperson for the agency.

But according to one of those officials, Sueno was fired because of irregularity in the purchase of firetrucks from Austria.

Interior Undersecretary for Public Safety Jesus Hinlo said Sueno was sacked because of his involvement in the purchase of the firetrucks without a competitive public bidding.

“There is a [case pending in] the Supreme Court involving the firetrucks but Sueno still proceeded with the transaction,” Hinlo said in a phone interview on Tuesday.

“There should be due diligence, that’s the issue that I think weighed heavily in the decision of the President,” he said.

Legal opinion

Hinlo could be right, as Mr. Duterte, in a speech at the Metropolitan Manila Development Authority (MMDA) on Tuesday night, referred to a legal opinion that Sueno had told him he knew nothing about.

“If you answer me with that kind of statement, that you never read the legal opinion of the legal officer of your own office, it’s either you’re taking me for stupid, an idiot, or you are lying through your teeth,” Mr. Duterte said.

“That’s why I said son of a bitch. So I said, ‘You’re fired.
I simply said, ‘You’re fired,’” he said.

Malacañang said earlier on Tuesday that Mr. Duterte sacked Sueno for “loss of trust and confidence.”

Sueno had a reported rift with his three undersecretaries, who accused him of corruption, shielding a politician linked to illegal drugs and other wrongdoings.

Mr. Duterte questioned Sueno about his activities before sacking him on Monday, presidential spokesperson Ernesto Abella said on Tuesday.

Warning to others

He said Sueno’s dismissal should serve as a warning to other government officials that Mr. Duterte would not tolerate any wrongdoing even in his Cabinet.

Sueno’s dismissal took effect right after Mr. Duterte’s pronouncement on Monday, according to Executive Secretary Salvador Medialdea.

An officer in charge for the DILG will be announced soonest, he added.

At the Philippine Army headquarters, Mr. Duterte told reporters that he was looking for a replacement for Sueno but he would not name former Sen. Ferdinand “Bongbong” Marcos Jr. to the top DILG post because Marcos had a pending electoral protest concerning his loss in last year’s vice presidential election to Leni Robredo.

“No, I don’t think so. He would abandon his appeal. He would have to let go of it. When you are appointed to a position, it would be lost for all intents and purposes,” Mr. Duterte said.

Sueno was fired at the end of the Cabinet meeting in Malacañang late on Monday, the same day he parried calls from his underlings in the DILG for his investigation for the purchase of firetrucks from Austria worth P20 million even though there were alternatives available for just P7 million.

Abella declined to provide details of what Mr. Duterte had found about Sueno.

He said, however, that Mr. Duterte had checked the activities of Sueno. Among the questions that Mr. Duterte asked Sueno, Abella said, was whether he had traveled to a certain country and whether he knew the background of a certain situation.

“The President was quite open and frank in questioning the secretary, initially, in fact, at the beginning of the meeting,” Abella said.

After questioning Sueno, Mr. Duterte moved on to other topics and the Cabinet meeting went on for several hours.

When Mr. Duterte made a closing statement, he announced that he was letting Sueno go.

A “short exchange” followed, Abella said, but gave no details.

He said the reason for Sueno’s dismissal went beyond the complaints of DILG officials.

It wasn’t clear whether Sueno would be formally investigated and possibly prosecuted.

‘I’m not corrupt’

In a statement, Sueno insisted on his innocence, but said he respected Mr. Duterte’s decision.

“I wholeheartedly accept the decision of the President. It is his call if he wants me in his Cabinet or not. But for the record, Mr. President, and I can say this with all honesty and sincerity, I am not corrupt,” Sueno said.

He said Mr. Duterte was given “wrong information by those salivating” for his post from the start.

“I just wished the information was validated. If only the President asked DILG personnel from the central down to the regional and field offices, he would have known who among us are more credible and trustworthy,” he said.

Sueno said he was ready to face any investigation to clear his name.

Assistant Secretary Ricojudge Janvier Echiverri early on Tuesday said the row between Sueno and his three undersecretaries—Hinlo, John Castriciones and Emily Padilla—erupted after Sueno decided to retain the executive right to approve promotions and contracts.

Echiverri said that some people in the DILG felt that if Sueno had to go, then his critics should also go.

Interior Secretary Ismael Sueno was fired by President Rodrigo Duterte during a Cabinet meeting on Monday night.

A Malacañang source initially told GMA News that the directive was issued during a Cabinet meeting, after an argument broke out between Sueno and other officials.

Justice Secretary Vitaliano Aguirre II, meanwhile, confirmed the news during an interview with GMA News’ Arnold Clavio on Unang Balita.

Aguirre said the Cabinet meeting opened with the topic on allegations against Sueno.

“Sa umpisa pa lang po ng Cabinet meeting eh yun ang aming nabuksang topic ng ating? pangulo. Pero afterwards alam naman po nating lahat inannounce niya na parang terminated na si Sec. Sueno because of some allegations,” he said.

Presidential spokesperson Ernesto Abella also confirmed that President Rodrigo Duterte has  dismissed Sueno.

“President Rodrigo Roa Duterte has dismissed Department of Interior and Local Government Secretary, Mr. Ismail Sueno, citing loss of trust and confidence.,” Abella said.

He said Sueno’s dismissal was announced at the end of the 14th Cabinet meeting.

Abella said Sueno’s summary dismissal “served as a warning that Mr. Duterte would not countenance any questionable or legally untenable decisions by any member of the Cabinet. ”

“The Secretary had, in fact, been instrumental in convincing the President to run for election, but this did not deter the President from pursuing his drive for a trustworthy government by addressing issues like corruption,” he added.

Duterte hinted in a speech on Sunday in Cagayan de Oro City that he will fire another government official.

“In due time, I’m going to dismiss another official, Pu— ina, ang titigas talaga ng ulo,” he said.

A confidential memorandum sent to President Duterte alleged that the DILG secretary had abused his position. Sueno denied the claims.

In a statement last month, Sueno expressed readiness to be replaced as DILG secretary.

“We serve at the pleasure of the President. It is within his power, wisdom and discretion to appoint members of his Cabinet,” he said.

“With the information being floated about the change at the helm of the DILG, I take no offense whatsoever. It is business as usual for me as I dispense my duties and functions with the blessings of President Duterte,” he added.

A former South Cotabato governor, Sueno was appointed to the top DILG post in 2016 by President Duterte.

Associate Justice Presbitero Velasco Jr says the notary public admitted that the senator’s affidavits were already signed before she and Senator Leila de Lima met.

MANILA, Philippines – After scrutinizing the affidavit submitted to the Supreme Court (SC) by notary public Maria Cecile Tresvalles-Cabalo, Associate Justice Presbitero Velasco Jr said the lawyer herself admitted violation of the rules on notarial practice.

Velasco made the statement at the continuation of the High Court’s oral arguments on Senator Leila de Lima’s petitions related to her arrest for drug charges on Tuesday, March 28.

Velasco pointed out that the notary public admitted that the senator’s affidavits were already signed before they met.

Section 6 of the rules on notarial practice requires the individual to personally appear before the notary public and sign the document in the presence of the notary.

However, Cabalo’s affidavit implies that such did not happen.

Solicitor General Jose Calida quoted from Cabalo’s affidavit, which says: “I was informed that the petition was already signed and ready for notarization. I was then provided the petition by her staff.”

“Because the jurat in the verification and certification against forum shopping was fabricated, the instant petition is considered unsigned pursuant to Section 4, Rule 7 of the Rules of Court. An unsigned pleading produces no legal effect,” Calida said in his opening statement as he took the floor for the first time to argue for the respondents.

If only for that violation, Calida is calling on the SC to dismiss De Lima’s petitions.

Calida had alleged that Cabalo never personally met De Lima on the day that the senator’s affidavit was notarized on February 24 or the day she was arrested and detained at Camp Crame.

De Lima’s camp had explained that Calida’s evidence was the logbook of the custodial center of the Philippine National Police (PNP) where De Lima is detained. But the notarization happened at another place inside Crame – the headquarters of the Criminal Investigation and Detection Group (CIDG.)

Velasco clarified Cabalo’s affidavit and asked De Lima’s lead counsel in the oral arguments, former solicitor general Florin Hilbay, if the notary public put the impression of her seal when Cabalo and De Lima met.

“I am not aware,” Hilbay responded.

Mocha Balita: Duterte accuses mining firms of funding destabilization

MANILA – President Rodrigo Duterte on Monday accused some mining firms of financing destabilization moves against his government.

In a news conference in Malacañang, Duterte said mining firms, which he did not name, were funding the opposition to undermine his government.

“Kayong mga mining, I know you are funding the opposite side. Alam ko na ngayon kung sinong gumgastos sa kanila. I know that some of you are giving funding to the other side to destabilize me. If the police and military will allow it, it’s their problem,” Duterte said.

Duterte issued this statement amid the heated debate over Environment Secretary Gina Lopez’s decision to close down 23 mines and cancel mineral sharing agreements.

The Commission on Appointments (CA) may decide on her appointment this week before Congress goes on a break.

Lopez has faced strong opposition from groups benefiting from the country’s mining industry. She said mining only benefits the few and destroys the environment.

During the news conference, Duterte again came to Lopez’s defense, saying the latter is telling the truth.

“Is Gina a liar? No, I don’t [think so],” he said.

“How can you argue with Gina when she is presenting, confronting you with a visual thing? Kami dito, it appalls us na kung mag-lobby-lobby kayo ng mining dyan, gusto niyo ako palitan na president na paluhurin niyo, to do your bidding,” he added, as he held pictures of mining sites supposedly showing massive environmental destruction in several parts of the country.

DAVAO CITY – Presidential sister Jocelyn Duterte’s dance instructor, who was supposedly killed many years ago on orders of then Davao City Mayor Rodrigo Duterte, posted a six-line message on Facebook on Tuesday, saying he was very much alive.

Retired SPO3 Arthur Lascañas, who appeared at the Senate on Monday, reiterated his claim that he headed the Davao Death Squad for Duterte and alleged that he killed hundreds of people on Duterte’s orders, including his sister Jocelyn’s dance instructor, Ruben Borja Baguio.

But Baguio, obviously irked at claims he had been killed for allegedly being a gigolo, wrote in an apparent message to Lascañas and another witness Edgar Matobato: “What’s your problem? Put your acts in order! Don’t you have something to say anymore?”

Baguio said he has been living peacefully until he was dragged into the investigation on the President’s alleged involvement in summary executions here when he was still mayor.

Baguio said he wanted to “clarify” to all that “it was not true I had been killed.”

“I earn my living decently so please stop the issue,” he added.

The Philippine Daily Inquirer traced Baguio’s Facebook account to August 23, 2011, when it was first opened.

On it, he mostly posted or shared religious articles and quotes, aside from his photos and those of his family and friends.

He also had photos of him with Jocelyn and with Dionisia Pacquiao, mother of boxing champion Sen. Manny Pacquiao.

During the campaign period, Baguio – also a body-building enthusiast – posted pro-Duterte memes and was even photographed doing the Duterte fist sign.

Jocelyn, 68, told the Inquirer by phone that Baguio has been her dance instructor since 2007.

“From 2007 to present. He is my only DI,” she said, adding that they regularly meet at the only ballroom dancing venue in town.

Lascañas had been steadfast in his claim that they had killed Jocely’s DI upon then mayor Duterte’s order because he was dating his sister only for money.

He said he was certain about the job and that they buried the body of the DI inside the Laud quarry in Maa.

Jocelyn, who said she watched Lascañas give his testimony at the Senate on TV, concluded that it was all a farce and part of Senator Antonio Trillanes IV’s effort against his elder brother.

She advised Trillanes to get “certified true and correct” witnesses because the effort against the President has descended to the level of “showbiz” or a “telenovela.”

“You’re looking stupid…you’re wasting the people’s money given to you as salary. Good luck to your DDS sequel!,” she also said in an earlier statement.

The alleged killing of Jocelyn’s DI first made the news in September 2016 when Matobato testified before the Senate Justice and Human Rights Committee that the then mayor ordered him and other henchmen to chop him up.

He said the DI was only among hundreds of people killed by the so-called Davao Death Squad during Duterte’s terms as mayor.

Even then, Jocelyn had already branded Matobato’s claim as “a total lie and a serious lie.”

She said the exposé was part of the “politically-motivated plot” masterminded by Senator Leila de Lima against her brother.  SFM/rga

Foes rejoice looming De Lima arrest

MANILA – Several political opponents of Senator Leila de Lima on Thursday expressed elation over a local court’s arrest order against the embattled lawmaker.

Presiding Judge Juanita Guerrero of Muntinlupa Regional Trial Court (RTC) Branch 204 signed the order to issue an arrest warrant against De Lima.

Guerrero’s branch handles the case against De Lima, her former driver and former partner Ronnie Dayan, and former Bureau of Corrections officer-in-charge Rafael Ragos.

 President Rodrigo Duterte’s chief legal counsel, Salvador Panelo, said the “law of karma has finally caught up with the Senator in terms of being arrested and detained.”

Panelo noted, it was De Lima who “effected the arrest of former President (Gloria Macapagal Arroyo) despite the absence of a criminal charge and a warrant of arrest she will now be arrested and detained pursuant to a warrant of arrest issued by a competent court.”

The presidential legal counsel said De Lima will now be given the chance to refute the allegations against her in court.

“This is where the real battle begins and not in the media that she relishes to use against the President,” he said.

Justice Secretary Vitaliano Aguirre II, who has locked horns with De Lima several times in the past, said the arrest order for De Lima was “inevitable,” noting that the senator’s pending motion to quash the charges would not stand in the way of her arrest.

“The motion to quash will not prevent the issuance of warrant of arrest. As long as the court studied the case…the court has no alternative but to issue a warrant,” Aguirre told ANC.

House Speaker Pantaleon Alvarez, meanwhile, said “justice is working in our beloved nation” with the arrest order for De Lima.

The Volunteers Against Crime and Corruption, one of those who filed a case against De Lima, said the arrest order for the senator is a “positive development.”

“Slowly but surely, the wheels of justice continue to grind against Senator Leila de Lima. The issuance of a warrant of arrest is but the latest in a series of exceedingly positive developments in the war on drugs…,” VACC legal counsel Ferdinand Topacio said in a statement.

“We are confident that we can count on the continued vigilance and hard work of all our partners in the criminal justice system in order to bring the drug trafficking cases against Sen. De Lima to its final conclusion: her imprisonment for the rest of her life,” Topacio said.

House Committee on Justice Chair Reynaldo Umali, who led a hearing on De Lima’s alleged drug links, said the senator “can ably defend herself, considering her extensive knowledge of the law.”

“On the other hand, the prosecution is now put to task to prove its case. Am hopeful that at the end of the day, the ends of justice is truly served,” he said.

In De Lima’s case under Guerrero’s Branch 204, she is accused of receiving drug money which was delivered by Ragos.

He said they delivered P5 million, which came from convicted drug personality Peter Co, to De Lima’s driver, Ronnie Dayan, in November 2012.

Aside from De Lima’s case before the Branch 204, she is also facing charges before the Muntinlupa court’s Branch 205 under Judge Amelia Fabros-Corpuz. The senator’s co-accused in the cases before this branch is her nephew Jose Adrian Dera.

Judge Patria Manalastas-De Leon of Branch 206 handles De Lima’s cases with co-accused Dera, former BuCor chief Franklin Jesus Bucayu and his alleged bagman Wilfredo Elli, De Lima’s former aide Joenel Sanchez, and NBP high-profile inmate Jaybee Sebastian.
